European Commission launches Consultation on ePrivacy Directive
The European Commission has launched a public consultation on the existing ePrivacy Directive 2002/58/EC (Directive), which protects privacy and personal data in the European Union’s electronic communications sector.
The purpose of the consultation is to gather input on the performance of the Directive so far, and to seek views on the possible solutions for its reform. The Commission will use consultation feedback to prepare a new legislative proposal on ePrivacy, which is expected in late 2016. These steps are part of the Commission’s wider Digital Market Strategy to reform the EU’s digital and technology laws.
The Commission has identified issues for potential reform in the Directive, including:
- ensuring consistency with the General Data Protection Regulation, which comes into force on 25 May 2018;
- making updates reflect technological advancements;
- enhancing the security and confidentiality of communications throughout the EU; and
- addressing inconsistencies between EU Member States as to enforcement of the Directive.
Interested parties may respond to the consultation through an online questionnaire by 5 July 2016.
