Computer Weekly Article on Agile Contracting

White & Black Senior Associate Nick Mitchell is quoted in an article in Computer Weekly on contracting for agile software development.

Agile is a very popular method of managing software development, first described in 2001, which explicitly avoids detailed documentation or specificiations in favour of flexibility and close collaboration. No consensus has been reached on how to document agile processes, responsibilities and apportion risks in a way that protects the parties, and particularly the customer, if a project fails.

Nick has dealt with a number of supplier disputes on major ICT contracts where agile methodology has been adopted, or where the parties at least say they are working in an agile manner.  He believes that new approaches to contracting can mitigate the risks to customers that are inherent in agile methodology.
